The question of the night is whether presidential immunity applies to criminal conduct, in addition to civil conduct.
The primary arguments in favor of presidential immunity in the criminal context is two-fold: 1) criminal litigation implicating the president would distract the government and the president from the essential functions of government; and 2) criminal litigation implicating the president would place a divisive strain on the American public. Both of which are bad for America as a whole.
